Crown seeks prison term for piano teacher who showed porn to four-year-old girl

Entrance to the Calgary Courts Centre.

Showing a young piano student pornography on his phone and trying to get her to touch him sexually should land a Calgary music teacher a five-year prison term, a prosecutor argued Monday.

But the lawyer for Darrin Hogue said a punishment in the two- to three-year range would be more appropriate for the former instructor at Harmony Music School.

Hogue pleaded guilty earlier this year to three charges relating to his dealings with a four-year-old girl whom he was offering private piano instructions separate from his employment with Harmony.

Crown prosecutor Aurelie Beland said Hogue’s conduct constituted a breach of a position of trust and he engaged in victim blaming, suggesting his young victim wanted to see the pornography on his cellphone.

Hogue, 35, admitted to charges of inviting a minor to sexually touch him, making child pornography and accessing the illicit smut.

According to a statement of agreed facts, Hogue was at the girl’s parents’ home in the basement when he showed her videos of “boys” and “girls” engaged in sex.

The child was unable to tell authorities the ages of the participants, but a later search of Hogue’s phone showed he’d been accessing child pornography for nearly four years.

In the hours leading up to his Feb. 18, 2018, visit to the girl’s home he downloaded dozens of videos of child pornography.

Beland told Justice David Labrenz that this showed evidence of planning and deliberation by Hogue, who also convinced the child to strip naked while he video recorded her and asked her to touch him sexually.

But in seeking a sentence of as little as two years, defence lawyer Jeinis Patel argued his client acted impulsively.

Labrenz will sentence Hogue on Thursday.
